Tax for non-residents

The tax calendar of a non-resident owner in France: returns, notices and payments, month by month

A property in France imposes a calendar on its owner, wherever they live: an income tax return in spring even without French income, an occupancy declaration when the property’s situation changes, the IFI above a certain wealth, local taxes in the autumn. This dossier gives that calendar month by month, says what is done online from abroad, what missing a deadline costs, and what Home Select organises so that you miss none.

Which logic governs this calendar?

Two criteria decide everything. The first is residence: it determines your tax regime abroad and whether a tax treaty between France and your country of residence applies. The second is the nature of the income or taxable fact: rent, a capital gain, wealth, a tax attached to ownership are not declared at the same time, on the same form, or through the same channel.

These two criteria explain why two owners of the same building can have two different calendars, and why yours can change during the year: a marriage, a move, a first letting alter the boxes and the deadlines. Hence the recommended method: once a year, before the filing season opens, check that nothing has moved, and have that point validated by a partner tax adviser in case of doubt.

Keep one reassuring constant in mind: France taxes the income of its buildings whatever the owner’s residence, but the applicable tax treaty organises the split and prevents double taxation. The calendar is therefore always built from the treaty, before any list of forms.

Which families of filings concern the owner?

Four families structure the year of a non-resident owner, each with its own trigger.

Rental income first. If the property is let, furnished or unfurnished, the rents received in France are declared there each year, on the forms dedicated to the matching category, at the rhythm of the spring filing campaign. The applicable regime, simplified or real route, depends on your situation and is chosen with an adviser.

The capital gain next: it is not declared over the year, but on the occasion of the resale. The notaire completes most of it at signature, and formalities specific to sellers established outside France are added, so that the resale is prepared fiscally even before a buyer is found.

Wealth tax on real property, for French estates reaching the threshold set by law: the filing accompanies the spring campaign, and the wealth concerned is valued under precise rules, reflecting the nature of the property held in France. No figure here: only your adviser can say whether your wealth crosses the threshold.

Property tax, lastly: it is not declared, it is issued. Built property in France owes it every year, the notice arrives automatically at the billing address or in the online space, and payment follows in autumn. Its calculation, its possible exemptions and the residence tax on a second home are the subject of the neighbouring dossier on local taxes on a property held from abroad.

Which documents should you gather beforehand?

The filing season is prepared before it opens. Here is the checklist of papers that recur in non-resident owners’ files.

  • The lease and its inventory, with the rent demands or receipts for rents paid.
  • Deductible or payable charges: co-ownership charges, property tax, insurance premiums, works, fees.
  • The statements of the French bank accounts receiving the rents.
  • Last year’s tax notice, with your identifiers and tax references.
  • Proof of your residence abroad and, where relevant, the identifying elements of the applicable tax treaty.
  • The papers for the year’s events: acquisition, works, change of tenant, move.

Build this folder once, keep it up to date continuously, and the filing season becomes a formality of a few hours instead of a document hunt against the clock.

Through which channels do you file and pay?

The channel depends on the filing. The annual income return is filed online from abroad in most situations, with a filing window of its own for non-residents; some situations still use a paper form, notably when the return cannot be pre-filled. The filings completed by the notaire on resale go through their own circuits, and the wealth-tax notice follows the main return.

Payment follows the same channels: direct debit from a bank account, online payment at due date, or a paying agent for certain withholdings. This is where a properly funded French account proves its worth: a missed debit on a tax generates surcharges that a simple schedule of provisions would have avoided.

Two practical prerequisites deserve to be settled once and for all. The online space first: create or reactivate it now, with your identifiers, since some non-resident procedures assume an access already working on filing day. The address next: the administration gladly writes to the property’s address; flag your correspondence address abroad, or have the property’s mail collected, so you never discover a notice after the deadline.

Two attitudes face this landscape. Annual improvisation, rediscovering the forms every spring; or continuous support from a partner tax adviser, who prepares, files under mandate and tracks the notices, with an annual synchronisation meeting. The second costs coordination, the first costs penalties.

What do you risk by missing a deadline?

The consequences of a miss are of two kinds. The first is financial: a late or incomplete return exposes you to surcharges, whose amount follows their own rules, and a spontaneous regularisation always costs less than one imposed after an audit. The second, less well known, is operational: on resale, certain tax formalities condition the payment of the price, and a filing record running late can delay the buyer’s payment, or even jeopardise the sale itself. A well-kept calendar is therefore also an asset-protection measure. The same holds for a notice left sleeping in an empty letterbox: silence never suspends a deadline, and the administration runs it against you all the same.

Every filing calendar mirrors a personal trajectory: acquisition dates, letting regime, wealth, country of residence.

What Home Select organises around your tax calendar

A property’s tax calendar starts on the day of signing: the occupancy declaration, the opening of the online account, the choice of direct debit are done in the weeks following the deed. At signing, Home Select hands you the dated list of these first steps, with the documents they require.

For the annual return, we introduce you to a tax adviser used to non-residents, who knows your country’s treaty and files for you. The returns and their content are theirs, under their responsibility: our role is that you know what to do, when, and whom to turn to.

Frequently asked questions

My property is not let: do I still have annual filings?

With no rent, there is no income to declare, but the calendar does not stop there: wealth tax on real property may concern you depending on its size, property tax is still issued automatically, and a resale will trigger its own obligations. An annual check with a partner tax adviser is enough to miss nothing.

Can I file everything online from abroad?

In most situations, yes: online filing is open to owners established outside France, and payment follows the same channels. In some cases a paper form remains in use, notably for certain returns completed by the notaire on resale. A partner tax adviser can also file for you, under mandate.

What happens if I discover an oversight from past years?

A spontaneous regularisation is always preferable to an oversight discovered by the administration: penalties are gentler and the file restarts on a clean base. Gather the documents for each year concerned and entrust the process to a partner tax adviser, who will gauge the extent of the regularisation and complete it in due form.
